- What are the modalities of qualification at SISCOMEX?

+

Legal Entity and Private Individual. The legal entity modality is divided into sub-modalities:Express: it is intended to legal entities or operations concerning to Article 2 (a), I of the IN RFB n. 1.603/2015. Limited: legal entity can import up to US$ 150 thousand each six months. Unlimited: legal entity can import under currency hedging, every six consecutive months, over the limit of US$ 150 thousand, compatible with its financial capability.

- Is it possible to carry out an import operation without having a full container?

+

Yes, it is. At the international trade your import can come in LCL container (Less than Container Load), which means a consolidation among loads from other importers. The condition of selling of exporting should be taken into consideration, whether export low quantity is allowed.

- I intend to start the imports by my company. Which procedures should I take?

+

First, it is necessary to register your importer by the Federal Revenue from your jurisdiction, known as RADAR or access to SISCOMEX. It should also be done other accreditations which will depend on the import product and the modal used. If the import comes by ship, a register at Merchant Navy, port terminal, should be carried out. If the import product requires concurrence at MAPA, ANVISA, among others, new accreditations will be necessary.

- What are the differences between the modalities import on behalf of third parties and import by order?

+

First, we will briefly identify both modalities of import:Import on behalf of third parties: it is a service provided by the company – the importer – , that which promote, on his behalf, the import customs clearance of goods acquired by other companies – the buyer –, due to the agreement previously signed, which can also include the provision of other services concerning to the business transaction, as the prices quotation execution and the trade intermediation (art. 1 of IN SRF n. 225/02 and art. 12, § I of IN SRF n. 247/02).

Import by order: it is that in which a company acquires goods overseas inhouse resources and promotes its import custmos clearance, in order to subsequently resell them, to orderer company previously determined, due to the agreement between the importer and the orderer, such object should comprise, at least, the deadline or the operations settled (art. 2, § 1, I of IN SRF n. 634/06).

Unlike what occurs at the import by order, the exchange transaction for payment of an import of behalf of third parties can be carried out on the importer behalf as well as the orderer, as settled at Market and International Capitals Regulations (RMCCI – Title 1, Chapter 12, Section 2) of Brazilian Central Bank (BACEN).

Other difference between the modalities is that at the import by order, the exchange transaction for import payment should be carried out uniquely on the importer behalf, as settled at Market and International Capitals Regulations (RMCCI – Title 1, Chapter 12, Section 2) of Brazilian Central Bank (BACEN).

The Import on Behalf of Third Parties and by order transactions are clearly distinct, since the first features the importer trade company only as service provider of the customs clearance and of others concerning to the trade transaction, and the second one, as the effective importer of foreign products for a unique orderer.

- What does load consolidation mean?

+

Load consolidation consists of grouping several kinds of small loads, which are addressed to the same destiny, adjusting them inside containers and/or pallets to be sent. Thus, a transportation cost decrease and improvement at quality and at the level of service delivery is provided to the customers.

- I have an import company, but I need to finance imports. Is it possible?

+

Yes, It is. There is, in all banks, the FINIMP (Financing to Import) in which the bank in Brazil, capture resources overseas, disregarding, therefore, any SELIC variation, transferring it to the importer. The resource will not cover the payment of Federal and State taxes II/IPI/PIS/COFINS/ICMS.
